In Cyprus, the Supreme Court overturned the conviction of a British woman given a four-month jail for making a false claim that she was gang-raped by dozens of Israeli’s during her vacation in Cyprus in 2019, as said by the defence lawyers.
Michael Polak, who was one of the lawyers from the team of lawyers. she is also representing the woman, called Monday’s decision a “watershed moment” for the woman and the other women of the world who find themselves in the same position.
Polak said in the Supreme Court that the British woman did not get the fair chance to speak and that important fair trial provisions were “totally ignored in the case”.
He added that the “young, weaker woman was not only mistreated” but also sent in a trial that was “manifestly unfair”, as the Supreme Court found.
According to the Polak that the opponent team fought the case with “one hand tied behind the back” and that had decided as to guilt before the proceedings had just started”.
As per the Lawyer, Nicoletta Charalambidou called the ruling “an essential day for women’s rights” in Cyprus. The defence team would now try to understand why authorities failed to “effectively investigate” claimed by some reports.
After the orders, the woman’s family has shown relief that Cypriot government finally recognised the weaknesses in their legal process”.
However, this decision doesn’t excuse how she was treated by the police or the judge or those in authority; it does not carry with it the hope that my daughter brings some positive energy in her life, said the statement.
According to the lawyers, the woman has not been revealed. She was just 19 when she got arrested and suffered from a stress disorder, and was pressured to make an “unreliable” retraction.
They said the “disrespectful” lower court judge Michalis Papathanasiou did not give defence lawyers the chance to put forward evidence supporting women’s claims.
