Abu Dhabi, UAE: A young man filed a lawsuit before the Abu Dhabi Family Court and Civil and Administrative Claims, demanding that another young man (the defendant) pay him compensation of 100,000 dirhams and oblige him to pay fees and expenses.

Explaining his lawsuit, he said that while he was driving his vehicle, he unintentionally deviated towards the lane next to him, in which the defendant’s vehicle was travelling, and when I tried to apologize to the defendant for this act, he surprised me with unexpected behaviour, as he lowered the car’s windshield, to start directing insulting phrases towards me. He explained that the defendant did not stop there but rather veered strongly towards my vehicle and hit it several times.

Then the complainant went to the police station to open a report, after which the identity of the accused was identified and referred to the competent criminal court, which in turn issued a judgment convicting the accused so that the complainant went to the civil court to demand compensation for the material and moral damages he sustained.

He enclosed copies of penal judgments and before the court, such as the complainant’s attorney, as well as the defendant, and decided that he suffers from a mental illness and that he is taking drugs and medications without submitting to the court body documents proving the validity of his statements.

The Court of First Instance issued a ruling obligating the defendant to pay the complainant an amount of (30,000 dirhams) and obligated the defendant to pay fees, expenses, and fees.

The defendant was not satisfied with this judiciary, so he instituted his current appeal under a newspaper that was deposited in the registry and announced as a law, and at the end of it, he asked to accept the appeal in form and in the matter to cancel the judgment of the Court of First Instance and the judiciary again to reject the case.

In its ruling, the court said that it was established from the papers that a conclusive ruling was issued against the defendant in the criminal case, condemning the defendant for the charge of assaulting the integrity of the complainant’s body by hitting him with the car he was driving, and also for the accusation of insulting him, and this judiciary has become final and conclusive not to challenge it.

It indicated that the judiciary of the criminal court has authority over the civil court in proving the error.

Accordingly, the court decided to reject the appeal and uphold the judgment of the Court of First Instance.
